These Terms of Use ("Terms") govern your access to and use of the Kofi Amoa Photography website at kofiamoa.com (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
About this site
The Site is operated by Kofi Amoa Photography ("I", "me", "my"), a portrait practice based in Northern California. It exists to share portfolio work, essays, and a way to start a conversation about a session. It is not a storefront and not a substitute for the engagement letter that governs any actual portrait commission.
Intellectual property
All photographs, written text, designs, layouts, video, and other content on the Site are the work of Kofi Amoa unless explicitly credited otherwise, and are protected by United States and international copyright law. Copyright in the photographs is reserved by the artist. The "Kofi Amoa" name and visual identity are used as trade and service marks of the practice.
Nothing on the Site grants you any license to the photographs or other content beyond what is expressly stated below.
Permitted use
You may view the Site, follow internal links, and share links to public pages on social media or in personal correspondence. You may print a copy of a single page for your own non-commercial reference (for example, to discuss a session with a partner).
Restrictions
Without prior written permission, you may not:
- Download, copy, reproduce, republish, or redistribute any photograph or other content from the Site;
- Use any photograph or other content for commercial purposes, including advertising, promotion, products for sale, or editorial use;
- Modify, crop, recolor, retouch, or create derivative works from any photograph or other content;
- Remove or obscure any copyright, credit, watermark, or attribution;
- Use any content from the Site to train, fine-tune, or evaluate any machine-learning model, generative AI system, or dataset, whether commercial or non-commercial;
- Scrape, crawl, mirror, or systematically harvest the Site by automated means;
- Frame, embed, or hotlink content in a way that misrepresents authorship or the relationship between you and the practice;
- Use the Site in any manner that violates applicable law or infringes the rights of any third party.

Sessions, prints, and other engagements
Booking a consultation, commissioning a session, ordering prints, or any other paid engagement is governed by a separate written agreement between you and Kofi Amoa Photography. Nothing on the Site constitutes an offer to enter into such an engagement, and these Terms do not modify or replace any signed agreement that does.
Third-party services and links
The Site relies on, embeds, or links to third-party services — including Netlify (hosting and forms), Pixieset (consultation booking and gallery delivery), and Medium (the journal feed). Those services are operated by their providers under their own terms and policies. I am not responsible for their content, availability, or practices. Following an outbound link is your decision.
User submissions
If you send a message through the contact form or by email, you confirm that the information you provide is accurate and that you have the right to share it. By submitting, you grant me a limited license to use that information for the purpose of responding to and serving your inquiry, as described in the Privacy page.
Accuracy
I aim to keep the Site accurate and current, but content is provided on an "as is" and "as available" basis. Pricing references, availability, and program details may change without notice and are not binding until confirmed in writing as part of an engagement.
Disclaimer of warranties
To the fullest extent permitted by law, the Site and all content are provided without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
Limitation of liability
To the fullest extent permitted by law, Kofi Amoa Photography and Kofi Amoa personally will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your access to or use of the Site, even if advised of the possibility of such damages. Direct damages, where they cannot be excluded by law, are limited in the aggregate to one hundred U.S. dollars ($100).
Indemnity
You agree to indemnify and hold harmless Kofi Amoa and Kofi Amoa Photography from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site or its content.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
Changes
I may update these Terms from time to time. Material changes will be reflected by an updated effective date above. Continued use of the Site after a change constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect.
